Understanding the History and Function of the Visa Waiver Program

The Visa Waiver Program was established by Congress in 1986 to encourage tourism and short-term business visits while allowing U.S. consulates to focus on higher-risk visa applicants. The United Kingdom and Japan were among the first to participate in 1988. All VWP countries must allow reciprocal visa-free travel for U.S. citizens, typically for up to 90 days. Importantly, visitors using the VWP cannot extend their stay like regular visa holders, but in specific situations—such as marriage to a U.S. citizen or asylum—they may be eligible to adjust their status.

Electronic System for Travel Authorization (ESTA)

Travelers entering under the Visa Waiver Program must complete the Electronic System for Travel Authorization (ESTA) before departure. ESTA is an automated system used by U.S. Customs and Border Protection to assess eligibility by collecting biographical and security-related information. While it does not guarantee entry, it is required for VWP travel. ESTA approval is valid for two years or until your passport expires. Updates are required if your personal information or passport changes.
